Artwork Rental Agreement

Welcome to CanvasMax Art. This Artwork Rental Agreement ("Agreement") governs the rental of original artworks through CanvasMaxArt.com ("Website"), owned and operated by Sujeewa Hettithanthri ("Artist," "Owner," "we," "our," or "us"). By subscribing to or renting artwork through the Website, you ("Customer," "Renter," "you," or "your") agree to be bound by the terms set forth below.

1. About the Artist

CanvasMax Art is operated by Sujeewa Hettithanthri, an independent artist offering:

Original paintings for sale
Fine art prints for sale
Artwork rental subscriptions
Custom commissioned artwork

2. Eligibility

To rent artwork through our Website, you must:

Be at least 18 years of age.
Provide accurate billing, shipping, and contact information.
Have a valid payment method.

3. Rental Subscription Service

CanvasMax Art offers selected artworks on a rental basis through a recurring subscription plan.

The subscription provides the right to display the rented artwork during the rental period only.

Ownership of all rented artwork remains exclusively with the Artist unless separately purchased.

4. Rental Term

Rental periods begin on the date the artwork is delivered.
Subscriptions renew automatically unless canceled in accordance with this Agreement.
Customers may exchange, return, or purchase rented artwork subject to availability and applicable fees.

5. Rental Fees and Payments

Rental fees are charged according to the subscription plan selected at checkout.
Payments are billed automatically using the payment method provided.
All fees are stated in the applicable currency displayed on the Website.
Failure to make timely payments may result in suspension or termination of the rental service.

6. Security Deposit (Optional)

CanvasMax Art reserves the right to require a refundable security deposit for certain artworks.

If applicable:

The deposit amount will be disclosed before checkout.
Deposits may be used to cover damage, loss, excessive wear, or unpaid charges.
Any remaining balance will be refunded after inspection of the returned artwork.

7. Delivery and Shipping

United States and Canada

Shipping is provided free of charge for artwork deliveries and returns within the United States and Canada unless otherwise specified.

International Orders

Customers outside the United States and Canada are responsible for:

Shipping charges
Customs duties
Import taxes
Local fees imposed by their jurisdiction

These charges are non-refundable.

8. Customer Responsibilities

During the rental period, the Customer agrees to:

Handle artwork with reasonable care.
Keep artwork in a safe indoor environment.
Protect artwork from moisture, excessive sunlight, smoke, heat, pets, and other damaging conditions.
Follow any care instructions provided by CanvasMax Art.

The Customer may not:

Alter, modify, repaint, frame, or repair the artwork.
Remove artist signatures or labels.
Use artwork for commercial reproduction.
Transfer or sub-rent the artwork to another person.

9. Damage, Loss, or Theft

The Customer is responsible for any damage, destruction, loss, or theft occurring during the rental period.

CanvasMax Art may charge the Customer for:

Repair costs
Restoration costs
Replacement value
Fair market value of the artwork if repair is not possible

The Artist's determination regarding repair and restoration requirements shall be final.

10. Artwork Exchanges

Where available, Customers may request artwork exchanges under their subscription plan.

Exchange requests:

Are subject to artwork availability.
May require advance notice.
May be subject to additional shipping charges for international customers.

11. Purchase of Rented Artwork

Customers may choose to purchase a rented artwork.

If approved:

Ownership transfers only after full payment is received.
Rental fees previously paid may be credited toward the purchase price at the Artist's discretion.
The purchase terms will be communicated separately.

12. Returns

Upon cancellation or expiration of a rental subscription:

Artwork must be returned in its original condition, ordinary wear excepted.
Artwork must be properly packaged using the provided materials or equivalent protective packaging.
Return instructions must be followed carefully.

Failure to return artwork may result in additional charges.

13. Cancellation

Customers may cancel their rental subscription at any time.

Cancellation becomes effective at the end of the current billing period unless otherwise specified.

Artwork must be returned within the timeframe provided by CanvasMax Art after cancellation.

14. Intellectual Property Rights

All artwork, images, designs, photographs, and content remain the exclusive intellectual property of Sujeewa Hettithanthri.

Rental of artwork does not grant any ownership, copyright, licensing, or reproduction rights.

Customers may not:

Reproduce artwork commercially.
Create derivative works.
Sell reproductions.
Use artwork in advertising without written permission.

15. Commissioned Artwork

Commissioned artwork is governed by separate commission terms provided before work begins.

Commission deposits, timelines, revisions, approvals, and ownership rights may differ from rental terms.

16. Limitation of Liability

To the fullest extent permitted by law, CanvasMax Art shall not be liable for:

Indirect damages
Incidental damages
Consequential damages
Loss of profits
Business interruption
Emotional distress arising from use of the rental service

Our maximum liability shall not exceed the amount paid by the Customer during the preceding twelve (12) months.

17. Termination

CanvasMax Art may suspend or terminate rental services if a Customer:

Violates this Agreement.
Fails to make payments.
Misuses artwork.
Provides false information.

Termination does not relieve the Customer of outstanding obligations.

18. Governing Law

This Agreement shall be governed and interpreted in accordance with the laws of the jurisdiction in which the Artist operates, without regard to conflict-of-law principles.
